1. Introduction
These Terms and Conditions govern your use of the Job Giver Australia website and services. By accessing or using our services, you agree to be bound by these terms. Job Giver Australia Pty Ltd ("JGA", "we", "our", "us") operates as a recruitment agency facilitating connections between employers and job seekers across Australia.
2. Scope of Agreement
This agreement applies to:
- Any business proposed to be undertaken by JGA on behalf of the Client
- The employment, engagement, or other use by the Client of a Candidate introduced by JGA
In the absence of any other written agreement, the use by the Client of any curriculum vitae provided by JGA (or details therein) or employment or engagement of any Candidate introduced by JGA will constitute acceptance of these Terms and Conditions.
3. Services
Job Giver Australia provides recruitment services including:
- Permanent Recruitment — available Australia-wide. Services include candidate sourcing and advertising, resume screening, experience assessment, reference checks, and interview coordination.
- Labour Hire & Temporary Staffing — available only within New South Wales (NSW). All labour hire arrangements comply with the Fair Work Act, Workplace Health & Safety obligations, and NSW labour hire regulations.
4. The Placement
Key placement terms:
- JGA shall use reasonable skill and care in the sourcing and introduction of Candidates to the Client.
- The Client shall provide all information reasonably necessary to enable JGA to assess the suitability of a Candidate for a Placement.
- JGA will make every reasonable effort to ensure a Candidate suits the Client's notified requirements but provides no warranty that information provided by Candidates is correct.
- JGA gives no warranty that any Candidate is or will be willing or available to accept or commence any Placement.
- JGA will not be liable for any losses arising from the Candidate's acts or omissions, including in performing their employment.
- The Client acknowledges that the final decision to employ or engage a Candidate rests with the Client.
5. No Guarantees
Job Giver Australia does not:
- Guarantee employment outcomes
- Guarantee sponsorship or visa approvals
- Make hiring decisions on behalf of employers
Final employment decisions always rest with the employer. Recruitment services are separate from migration services. Migration advice, where applicable, is provided separately by a licensed migration agent.
6. Fees
Job Giver Australia does not charge job seekers any fees. Fees payable by the Client for a Placement are calculated as a percentage of the Candidate's gross Salary Package:

For Fixed Term Placements, fees are based on the equivalent annual full-time Salary Package. All fees are quoted exclusive of GST. GST shall be charged at the prevailing rate.
7. Payment Terms
- The Client will pay all invoices within 14 days of the date of invoice.
- The Client is deemed to have accepted the invoice if no dispute is raised within 7 days.
- Overdue payments are subject to a daily rate of 2.5% per annum above the base rate of the Commonwealth Bank of Australia.
- All costs incurred by JGA in recovering overdue amounts will be payable by the Client.
8. Retained Searches
Where the Client requests a retained search assignment, a fee is invoiced in three stages:
- 33% on JGA's agreement to undertake the assignment
- 33% when the shortlist is presented or after 30 days (whichever is sooner)
- Balance upon commencement of the Candidate in employment
If the Client withdraws the Placement before the Candidate commences or cancels the assignment, all three stages of the fee are payable immediately.
9. Introductions
The Client shall inform JGA and pay the applicable fee where:
- An introduced Candidate is employed or engaged by the Client within 12 calendar months of the initial introduction
- An offer of employment is made and accepted but no employment results (through no fault of the Candidate)
- The Candidate is introduced by the Client to a third party within 12 calendar months
10. Replacement Guarantee
No rebate of fees shall be made. Should the engagement of a Candidate terminate within eight (8) weeks from the start of the Placement, JGA shall seek a replacement Candidate on the condition that:
- The Candidate leaves of their own volition (not due to redundancy or change in role)
- JGA's invoice has been settled
- The Client has complied with relevant laws
- The request is given exclusively to JGA
- The replacement role is identical to the initial Placement
- JGA is informed in writing within seven days
The replacement guarantee applies only to the original Placement and not to replacement candidates. It does not apply to fixed-term contracts. The guarantee is valid for three months after termination.
11. Screening & Compliance
Screening may include:
- Right-to-work verification
- Resume and experience review
- Reference checks
- Skills assessments
- Police or background checks (role-dependent)
Employers remain responsible for final due diligence.
12. False Information & Misconduct
Providing false documents, misleading information, or unverified experience may result in:
- Immediate removal from recruitment
- Termination of services
- Notification to employers
13. Probation & Post-Placement
All placements are subject to employer probation periods. JGA is not responsible for:
- Employee performance
- Misconduct
- Workplace disputes
- Termination decisions
14. Limitation of Liability
Job Giver Australia is not liable for:
- Employer hiring decisions
- Employee conduct after placement
- Business losses
- Migration outcomes
Neither party shall be liable for indirect or consequential loss. If the Client hires a staff member of JGA within twelve months, a fee of 30% of their last annual salary is payable.
15. Confidentiality
Both parties agree to hold confidential information in confidence and not disclose it without consent unless required by law. Personal information is handled in accordance with the Australian Privacy Act. Information may be shared with employers for recruitment purposes with consent.
16. General
- Unenforceable clauses will be severed without affecting the rest of the agreement.
- Force majeure protection applies.
- This agreement is governed by the laws of the State or Territory in which the business is performed.
- No waiver or amendment is effective unless confirmed in writing by a Director of JGA or the Client.
17. Complaints & Disputes
Complaints must be submitted in writing. By using this website, employers and job seekers agree to the terms outlined above.
18. Definitions
- "Business" — work performed by JGA in relation to permanent or Fixed Term Placements.
- "Candidate" — any individual introduced by JGA.
- "Client" — you or your related bodies corporate under the Corporations Act 2001.
- "Fixed Term Placement" — a Candidate employed on a fixed term contract.
- "Introduced" — the sending of a CV or any communication identifying a Candidate.
- "Placement" — a position filled by a Candidate.
- "JGA" — Job Giver Australia Pty Ltd.
- "Salary Package" — the annual anticipated gross remuneration package including salary, superannuation, bonuses, commissions, allowances, and inducements. A car is valued at $25,000 per annum.
